These SMS Terms of Service (these “Terms”) govern the text messaging programs operated by the practices listed below which are affiliated with American Vision Partners (each, a “Practice”); they apply to your enrollment with the practice where you provided your number and consent (the “Program”). By opting in to the Practice’s Program, you agree to these Terms.

1) THE PRACTICES. Barnet Dulaney Perkins Eye Center, Arizona Eye Institute of Eye Surgery, Southwestern Eye Center, Ltd, Retinal Consultants of Arizona, LTD, Box Canyon Surgery Center, LLC, Eye Associates of Nevada – Wellish Vision Institute , Vantage Eye Center, a Medical Corporation, Vantage Surgery Center, LLC, Desert Peaks Surgery Center, LLC, Cataract Surgical Center of Lubbock, West Texas Eye, PLC, Marc Ellman, MD, PC d/b/a Southwestern Eye Institute, Vista Surgery Center, LLC
2) THE PROGRAM. The Program allows each Practice to send you recurring text messages, such as appointment reminders, notifications, and service-related messages. Message frequency varies.
3) ELIGIBILITY AND CONSENT. To enroll, you must be the account holder or an authorized user of the mobile telephone number you provide, and you must provide prior express consent to receive text messages from the Practice at that number. Consent to receive text messages is not a condition of purchasing any goods or services.
4) COST. The Practice not charge a fee to participate in the Program. Message and data rates may apply, depending on your mobile carrier and plan. You are responsible for any such charges.
5) OPT-OUT AND HELP. You may opt out of the Program at any time by replying STOP to any message you receive from the Practice. After you reply STOP, the Practice will send a single confirmation message and will not send you further messages unless you opt in again. For assistance, reply HELP to any message, or contact the Practice using the details in its privacy policy.
6) CARRIER LIABILITY. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed.
7) PRIVACY. The collection and use of information in connection with the Program is described in the Practice’s SMS Privacy Policy. To the extent any message contains your protected health information, use and disclosure of that information is also governed by the Practice’s Notice of Privacy Practices and applicable privacy laws.
8) CHANGES TO THESE TERMS. The Practice may update these Terms from time to time. Any changes will be posted on this page with a revised effective date, and your continued participation in the Program constitutes acceptance of the updated Terms.
